  1. These general terms of use (“Terms”) govern the relationship between “GREEN E-MOTION” OOD, hereinafter referred to as “GO e-motion” as the Supplier, on the one hand, and the Users of the website, buyers of goods located on the website http://www.goemotion.eu, hereinafter referred to as “Users”, on the other.

1.1 “GREEN E-MOTION” OOD is a company registered under the Commercial Code of the Republic of Bulgaria with UIC 206783092, with headquarters and management address: city of Varna, 28 Hristo Popovich Street, email address office@goemotion.eu, phone +359897999425.

1.2. The Company operates in accordance with the legislation of the Republic of Bulgaria, including the Consumer Protection Act and the Personal Data Protection Act.

The Company owns the rights to the Trademark “GO e-motion” under Registration Number 0161293N, filed with the Patent Office of the Republic of Bulgaria.

Please read the published General Terms of Use in full before using the information and commercial services offered on the Site (hereinafter referred to as the Services). If you do not accept the Terms set forth herein, you will not be able to use our Online Store. When using our services, available without registration, it will be an expression on your part that you agree to the Terms.

In connection with the Services provided, GO e-motion.bg processes personal data in accordance with the Personal Data Protection Policy (“Policy”), which is visible and easily accessible on our website.

This document contains information about the activities of “GREEN E-MOTION” OOD and the general terms and conditions for using the services provided by “GREEN E-MOTION” OOD, regulating the relations between us and each of our users.

Confirmation of the General Terms and Conditions is a necessary and mandatory condition for the conclusion of the contract between the User and the Provider GO e-motion.

  1. Agreement with the terms

2.1. The user declares that he is familiar with and accepts these General Terms and Conditions by checking the box “I agree with the General Terms and Conditions” on the registration form. Before clicking the “Registration” button, you have the opportunity to review and edit the information you have provided. You agree that electronic statements to GO e-motion and electronic statements from GO e-motion to you will be considered signed with a simple electronic signature in accordance with Art. 3, paragraph 10 of Regulation (EU) No. 910/2014, with the force of a handwritten signature. The authorship of these statements will be established in accordance with Art. 13, paragraph 1 in connection with Art. 13, paragraph 4, sentence 2 of the Law on Electronic Documents and Electronic Certification Services (“ZEDEUS”).

  1. 3. Using the services of the site

3.1. The use of the Services is possible with and without registration. The use of the Services in both cases will be considered an expression of agreement with the Terms.

3.2. Registration is carried out personally, and registration on behalf of other persons is not allowed. When registering, you are required to fill in the mandatory fields in the registration form (name, email address, etc.).

3.3. You undertake to provide true, complete and up-to-date data during registration and to maintain it as such. In case of inaccuracy in the data, you do not have the right to use the Services until it is eliminated.

3.4. You are responsible for all actions performed through your account using your username and password for access. You are obliged to immediately notify GO e-motion in the event of unauthorized access or the likelihood of such.

By accepting the General Terms and Conditions, the User agrees to the processing of his personal data on the basis of the contract concluded between him and GO e-motion.

  1. Responsibilities

4.1. GO e-motion is not liable for any damages resulting from visiting the Online Store and the information published therein.

4.2. The information about the products is provided as a characteristic by the manufacturers. GO e-motion is not liable for inaccuracies in this characteristic.

4.3. GO e-motion does not exclude the possibility of errors, inaccuracies or omissions due to technical or human factors and is not liable in this regard.

4.4. If, due to technical or human factors, a breach of the site by third parties or misuse of the information on the site without the knowledge of GO e-motion, you notice irregularities, please report them to e-mail: office@goemotion.eu

  1. 5. Definitions

For the purposes of these General Terms and Conditions, the following terms shall be understood as follows:

Site – http://www.goemotion.eu and all its subpages.

User/Client – ​​means any natural or legal person who has placed an order to purchase goods from the Merchant through the e-shop, who has confirmed their agreement with these General Terms and Conditions. In case of doubt regarding the data provided by the customer, the merchant reserves the right to refuse the order/terminate the contract by notifying the customer thereof.

General Terms and Conditions – these General Terms and Conditions, which include terms of use and delivery, voluntary dispute resolution, forms for withdrawal from the contract and replacement and any other legally significant information found on the Site.

Personal data – information about an individual – three names, date of birth, e-mail, telephone.

Goods – means any product owned by GO e-motion, offered on the website www.goemotion.eu. Each product is identified by its main characteristics and sales price.

Sales contract – a contract under which GO e-motion transfers or undertakes to transfer the ownership of goods to the consumer, and the consumer pays or undertakes to pay the price for them.

Procedure for alternative consumer dispute resolution – a procedure for out-of-court resolution of consumer disputes, meeting the requirements of this law and carried out by an alternative consumer dispute resolution body.

  1. Technical steps for concluding a contract.

6.1 Users primarily use the interface on the GO e-motion website to conclude contracts for the purchase and sale of goods offered by GO e-motion.

6.2. The contract is concluded in Bulgarian.

6.3 The contract between GOe-motion and the User represents these general terms and conditions, available at: https://www.goemotion.eu.

6.4 The party to the contract with GO e-motion is the User according to the data provided during registration and contained in the User’s personal profile. For the avoidance of doubt, these are the data with which an account was created with GO e-motion.

6.5 This contract is considered concluded from the moment of confirmation by the User, made by opening a confirmation link sent by GO e-motion to the User/Client’s e-mail, after the latter has registered on the site and entered a password. In cases of access to GO e-motion services without registration on the site, the parties consider the conclusion of a contract to be the confirmation of the order placed on the site by the User/Client.

6.6 When placing an order (with or without Registration on the site), the User receives confirmation by email that his order has been accepted. Before sending the ordered goods, GO e-motion has the right to contact the User at the phone number specified by him/her in order to specify details of the order and/or delivery.

6.7 GO e-motion is not responsible for failure to fulfill an order in cases where the User has provided false, incomplete and/or inaccurate data.

6.8 The statement for concluding the contract and the confirmation of its receipt are considered received when their addressees have the opportunity to access them.

6.9. Each order sent through the site will be considered regular by GO e-motion if a username and password have been used that the system has accepted as valid, regardless of whether they are used by a person other than the holder. The User is obliged to maintain the confidentiality of his/her username and password.

  1. 7. Order

7.1. In the event of a product being out of stock, GO e-motion reserves the right to refuse the order.

7.2. After selecting one or more products offered on the GO e-motion website, the User must add them to his/her list of products for purchase. Selecting products/products from the site is done by clicking on the “BUY” button. In this way, the selected product/product is added to a virtual “CART”, which contains information about each product, its quantity and price, as well as the total amount due for the selected products/products. All customers who are registered in the GO e-motion mobile application benefit from preferential prices. The customer is given the opportunity to apply a PROMO CODE owned by him, after which the total price of the amount due will be changed according to the customer’s promo code.

7.3. After the final selection of goods/products that the Customer wishes to purchase, he should click on the “ORDER” button.

7.4. The User/Customer is required to provide data for the delivery, as well as the payment and delivery methods, and then confirm the order through the site interface. This can be done by clicking the “ORDER” button.

7.4. When placing an order, the User receives confirmation by email that his order has been accepted.

7.5 In the event that GO e-motion does not have a product ordered by the User and cannot fulfill the Order, GO e-motion is obliged to notify the User of this.

  1. GO e-motion has the right to refuse to conclude a contract with an incorrect User.

8.1. GO e-motion has the right to treat a User as incorrect in cases where:

– there is a failure by the User to comply with the General Terms and Conditions;

– an incorrect, arrogant or rude attitude towards GO e-motion representatives is established;

– systematic abuses by the User towards GO e-motion are established.

  1. Prices

9.1. The prices of the offered goods are those indicated on the GO e-motion website at the time of placing an order, except in cases of obvious error.

9.2. The prices of the goods include VAT, in cases where it is provided for its calculation.

9.3 GO e-motion reserves the right to change the prices of the goods offered on the site at any time and without notice, and such changes will not affect orders already placed.

9.4 GO e-motion may provide discounts for the goods offered on the site, in accordance with Bulgarian legislation and rules set by GO e-motion. The rules applicable to such discounts are available at the place where the discount is displayed. The “PROMO CODE” option is an opportunity for each client/user to enter a code provided by GO e-motion to generate a discount. The code can be provided in various ways, such as sending by e-mail to the client, advertising campaigns, flyers and others.

Entering a PROMO CODE is done after clicking on the button “Click here to enter the code“. After entering it, you should click on the button “Apply promo code”. Thus, the system will generate the discount received by the client in the final price due for payment.

  1. Changes

10.1. Typographical errors, differences in color visualization, as well as changes in the design of the products are possible.

10.2. Because the Services can only be used in accordance with the current Terms, if you do not agree to them, we are not technically able to provide you with the Services in the Online Store. If you do not agree to the Terms, you must not use the Online Store. If you wish, you have the opportunity to close your account and terminate the contract at any time.

  1. Payment

11.1 When requesting an order, payment can be made in one of the following ways:

  • With cash on delivery upon receipt of the order.
  • Payment on site in the physical store;

  1. Terms, methods and deliveryterm

12.1. GO e-motion undertakes to ensure conditions for the proper packaging, transportation and delivery of the products, so that their qualities are preserved.

12.2. If the User has placed his order at the office of the Courier Company, he has a period of 5 working days, starting from the date of delivery, to accept it. After this period has expired, the order is canceled and returned to GO e-motion.

The delivery of the ordered goods is carried out through the following courier company:

Speedy – www.speedy.bg

The delivery is made to the consumer’s address on the territory of the Republic of Bulgaria, to an office of the courier company/machine or the order can be picked up from the physical store located in the city of Varna, 35 G. Benkovski Street, unless otherwise stated on the site.

The delivery costs are individually indicated in a table below. The User pays for courier services in the event of returning goods to GO e-motion, except in the event of goods being sent to the User by mistake by GO e-motion.

Before sending the ordered goods, GO e-motion has the right to contact the User at the phone number provided by him/her, in order to specify details of the order and/or delivery.

GO e-motion is not responsible for failure to fulfill an order in cases where the User has provided false, incomplete and/or inaccurate personal data, including when he/she has provided an incomplete, inaccurate or fictitious address or telephone number.

Delivery is carried out within the terms described under each delivery option in the order interface module. In exceptional circumstances, GO e-motion reserves the right to extend the delivery period, informing the User in a timely manner.

GO e-motion processes orders within 2 business days of placing the order, as delays may occur due to problems with the companies carrying out the logistics, as well as force majeure circumstances related to the Covid crisis, which imposes delays and problems with the logistics of the goods. Delivery is usually carried out within the usual period in practice in accordance with the selected delivery method. It is possible to extend the delivery period due to a temporary lack of a product ordered by you or its insufficient availability to fulfill the quantity requested by you, as well as in the event of a declared state of emergency or an extraordinary epidemic situation. In such cases, we will contact you for additional clarifications.

The User is obliged to inspect the goods at the time of delivery and to notify immediately of any discrepancies, shortages and damages. If the User fails to do so, it is assumed that the delivery has been accepted without objection.

GO e-motion reserves the right to change the available delivery and payment methods and/or the terms and conditions thereof at any time by publishing the available delivery and payment methods on the website without further notice.

– All prices include VAT and fuel tax;

– A fuel tax is charged to the indicated prices, subject to monthly update. Its amount is determined at the beginning of each month based on retail prices for diesel fuel. The amount of the fuel tax is announced on the website of Speedy AD, and for the month of July 2022 it is 16.5%

– For intercity shipments, a Toll surcharge is charged to the prices – a tax in the amount of 0.04 lv. without VAT for shipments weighing up to 31.5 kg.

Conditions:

“GREEN E-MOTION” OOD provides its customers with the opportunity to choose one of the following delivery methods for goods ordered through www.goemotion.eu:

  • To the address specified by the customer
    • To an office of the courier company Speedy or a Speedy vending machine
    • To the physical store of GO e-motion in Varna, ul. G. Benkovski” № 35.

Deliveries to an address specified by the customer:

In case the order is placed at a Speedy office, the customer has 5 working days from the date of delivery to receive it. An order not received within this period is canceled and returned to the warehouse at “GREEN E-MOTION” Ltd., and the amount paid for the order is not subject to refund.

*For shipments to smaller settlements, where the courier company Speedy has a specific weekly delivery schedule, the relevant schedule is followed.

**It is possible to extend the delivery period due to a temporary lack of the product you ordered or its insufficient availability to fulfill the quantity you requested, as well as in the event of a declared state of emergency or an extraordinary epidemic situation. In such cases, we will contact you for additional clarifications.

***We recommend that you track your shipment by the waybill number, which you receive by email after the shipment has been handed over to the courier company Speedy.

Deliveries to Speedy offices

When placing an order to a Speedy office, the customer has a period of 5 working days from the date of delivery of the respective shipment to an office in which to accept their shipment. After the expiration of the period, the order is canceled and returned to the warehouse at “GREEN E-MOTION” Ltd., and the amount paid for the order is not subject to refund.

In order to avoid unintentional errors, after each order the customer receives a notification by email confirming the order placed, to the contacts provided by the customer. Courier company Speedy will send the customer an email at the moment the order is accepted by Speedy for delivery, as well as an email/sms on the day of delivery.

Receiving ordered goods from the physical store GO e-motion:

“GREEN E-MOTION” Ltd. provides customers with the opportunity to request delivery of ordered products from the physical store. This delivery method is completely free for customers and allows them to receive the order easily and quickly at a time convenient for them.

An order not received within 14 days of the date of delivery in a store is canceled and returned to the warehouse at “GREEN E-MOTION” Ltd., and the amount paid for the order is not subject to refund

  1. Product Return

12.1. The consumer has the right to return products within 14 days of their purchase if they change their mind for any reason, provided that the product shows no signs of use and is in its original packaging. The costs of returning the shipment are borne by the consumer. Upon fulfillment of the above-described conditions, after receiving the product, GO e-motion undertakes to refund the User the amount for the returned product.

12.2. The refund of the amount is made in the manner in which it was received by “GREEN E-MOTION” Ltd., unless it is explicitly stated that the User prefers another payment method. Paid shipments with cash on delivery by the User are returned to the bank account specified in the User’s request to GO e-motion.

12.3. In order to exercise your right of withdrawal, you must notify Us of your name, address, telephone number, email, as well as of your decision to withdraw from the contract with an unambiguous statement. It is sufficient to send a message regarding the exercise of the right of withdrawal within the aforementioned 14-day period.

12.5. If you cancel an order, we will refund all payments we have received from you within a period of no later than 14 days from the date of return of the goods. The period is considered met if you send the goods back to us before the expiration of the 14-day period. You must bear the direct costs of returning the goods. In case of cancellation, the goods must be returned in their original packaging, intact and unused. In case of failure to comply with these conditions, we reserve the right to refuse to accept the returned goods and not to refund the amount paid by you.

  1. Intellectual Property

The intellectual property rights on all materials and resources, trademarks, copyrights, intellectual property rights, etc. located on the GO e-motion website (including the available databases) are subject to protection under the Copyright and Related Rights Act, belong to GO e-motion or the correspondingly indicated person who has transferred the right to use GO e-motion, and may not be used in violation of applicable law.

When copying or reproducing information outside the permissible limits, as well as in any other violation of intellectual property rights on GO e-motion resources, GO e-motion has the right to claim compensation for the direct and indirect damages suffered in full.

Except in cases where it is expressly agreed, the User may not reproduce, change, delete, publishes, distributes and otherwise discloses the information resources published on the GO e-motion website.

GO e-motion undertakes to exercise due care to ensure that the User has normal access to the services provided.

GO e-motion reserves the right to suspend access to the services provided. GO e-motion has the right, but not the obligation, at its discretion to delete information resources and materials published on its website.

  1. Termination and cancellation of the contract

GO e-motion has the right, at its discretion, without prior notice, to unilaterally terminate the contract if it establishes that the services provided are used in violation of these General Terms and Conditions, the legislation of the Republic of Bulgaria and generally accepted moral norms.

Except in the cases provided for in these General Terms and Conditions, the contract between the parties shall also be terminated upon termination of the activities of GO e-motion or termination of the maintenance of its website.

Outside the cases specified above, each of the parties may terminate this contract by giving one week’s notice to the other party in the event of non-fulfillment of the obligations under the contract.

The written form of the contract is deemed to have been complied with by sending an e-mail message.

  1. Conciliation clause

The parties declare that, in the event that any of the clauses under these General Terms and Conditions prove to be invalid, this will not entail the invalidity of the entire contract or its other parts. The invalid clause will be replaced by the mandatory provisions of the law or established practice.

  1. Amendment to the General Terms and Conditions

GO e-motion undertakes to notify Users of any amendment to these General Terms and Conditions within 7 days of the occurrence of this circumstance at the email address specified by the User.

When the User does not agree with the amendments to the General Terms and Conditions, the User has the right to withdraw from the contract without giving a reason and without owing compensation or penalty. In order to exercise this right, the User must notify GO e-motion within one month of receiving the notification under the previous article.

In the event that the User does not exercise his right to withdraw from the contract in accordance with the procedure set out in these general terms and conditions, the amendment shall be deemed to have been accepted by the User without objection.

  1. Applicable law

For all issues not regulated by these General Terms and Conditions, the provisions of the current legislation of the Republic of Bulgaria shall apply.

GO e-motion identifies Users of the site by storing log files on the Site’s server.

GO e-motion has the right to collect and use information about Users on the basis of and for the purposes of implementing the contract concluded with the User under general terms and conditions. The information through which the person can be identified may include personal data specified in the general terms and conditions, as well as any other information that the person voluntarily provides during registration. The information also includes any other information that the User enters, uses or provides when using the services.

GO e-motion takes due care and is responsible for protecting the information about the User that has become known to him/her during registration, except in cases of force majeure, accidental event or malicious actions of third parties.

GO e-motion may disclose personal data to third parties only in cases provided for by law and under the circumstances provided for by law or after explicit consent from the Users.
