Contract for the Sale of an Electric Vehicle

Today in the city of Varna this contract is concluded between:

I. Subject of the Contract

The BUYER purchases the described electric vehicle hereinafter referred to in this contract as the EV.

II. Price and Payment Method

Art. 2. The sale price of the described electric vehicle (EV) is ………….. BGN including VAT which amount is paid in cash or by bank transfer upon signing this contract.

III. Transfer of Ownership

Art. 3. Ownership of the item is transferred to the BUYER at the time of payment of the sale price under the terms and deadlines specified in Art. 2. The EV is not subject to return or exchange.

IV. Delivery of the Item

Art. 4. The SELLER fulfills its obligation to deliver the item with its physical delivery when purchased from a physical store and with the signing of a delivery note / waybill from a courier when purchased online.

4.1. Upon sale of the item the SELLER guarantees the operability of the EV.

V. Warranty. Warranty Terms. Period.

Art. 5. The SELLER provides a warranty for the EV for a period of 24 months for the body and 6 months for the electronics which includes: the battery, the engine, the controller, and the accelerator. The warranty period starts from the day of transfer of ownership of the EV as indicated in Art. 3 of this contract. By providing a quality warranty for the goods, the SELLER guarantees that the EV complies with the agreed terms and is fit for regular use.

5.1. The warranty does not cover defects arising from:

Fault of the buyer i.e. damage to the product caused by unqualified repairs, incorrect assembly, poorly assembled elements of the device.
Improper maintenance.
Mechanical damages.
Regular use (e.g. wear of rubber and plastic parts, consumables, etc.).
Unavoidable event, natural disaster.
Corrections to the EV.
Improper maintenance, incorrect placement, damage caused by low or high temperature, water, inappropriate pressure, impacts, deliberate design changes or construction, etc.

The warranty does not cover consumables: brake pads, tires, cables, handles, kickstands, discs, bearings, and accessories.

5.2. The warranty provided by the SELLER is valid under the conditions and terms specified in Art. 5 of this contract if the BUYER fulfills the following conditions:

Within the warranty period, the BUYER performs two annual inspections of the EV at a Go center specified by the SELLER. The inspections are at the expense of the BUYER.
The EV is charged with an original charger or at the Go centers of the SELLER.

5.3. Complaint procedure: The BUYER must immediately notify the SELLER of the occurring defect and provide the EV for inspection at the authorized service center of the SELLER. The transport costs for this are at the expense of the BUYER. If a defect covered by the warranty is found and the requirements of item 5.2 of this contract are met, the SELLER is obliged to satisfy the warranty claim by repairing or replacing the defective part within 30 days from the date of the claim unless a longer period is necessary in which case the SELLER will notify the BUYER. Upon submitting the claim the BUYER must provide a return address for the repaired EV at: eshop@goemotion.eu.

5.4. If the BUYER does not seek/collect the repaired EV from the authorized service center of the SELLER within 30 working days after the warranty satisfaction, the SELLER will charge a storage fee of 50 BGN for each day. If the amount of the due storage fee exceeds the value of the item “Green e-motion” LTD has the right to retain it.

5.5. If it turns out that the defect/damage is not covered by the warranty or is due to actions described in Art. 5, the costs for determining the cause of the defect are at the expense of the BUYER. At his request, repairs can be carried out with all costs being borne by him.

VI. Rights and Obligations of the Seller:

Art. 6. The SELLER is obliged to deliver the item under the conditions and terms of this contract.

6.1. The SELLER is obliged to remove defects within the warranty period under the conditions of Art. 5 of the contract.
6.2. The SELLER is obliged to indicate to the BUYER Go centers where the latter can carry out the necessary inspections under Art. 5 item 5.2 (for warranty validity) and have the battery charged.
6.3. The SELLER has the right to receive the sale price as the payment of the price is a condition for the transfer of ownership and delivery of the item.

VII. Rights and Obligations of the Buyer:

Art. 7. The BUYER is obliged to pay the sale price under the conditions and terms of this contract.

7.1 The BUYER declares that he is familiar with the warranty conditions and his obligations under Art. 5 item 5.2 necessary for the warranty validity. The BUYER also declares that he is familiar with the terms of use of the EV.
7.2. The BUYER has the right to receive the item under the conditions of this contract.

VIII. General Provisions:

Art. 8. This contract enters into force from the date of its signing.

8.1 Disputes arising from the interpretation, execution or non-performance of this contract shall be resolved by the competent court. When the dispute is not a consumer one under the CPA, based on Art. 117 para. 2 of the CPC, the parties designate the competent court in the city of Varna.
8.2. For unresolved issues under this contract, the provisions of Bulgarian legislation shall apply.
8.3. All amendments and supplements to this contract will be made in writing.
